New York Legislature Passes Bill Allowing State To Prosecute People Pardoned By The President

On Tuesday, the New York Assembly passed a bill that allows the state to prosecute people who receive a pardon from the President.

    What We Know:

    • This bill prevents people who have received presidential pardons from using double jeopardy to escape criminal charges.
    • Double jeopardy prohibits the government from prosecuting and punishing individuals more than once for a single offense.
    • The bill’s sponsor, Senator Todd Kaminsky told NPR, “The president’s threatened use of the pardon power is very troubling. It would be done to undermine an investigation to help out friends and family members.”
    • The assembly voted 90-52 in favor of the bill. The majority of the assembly is democratic.
    • Some Republican Assembly members were upset with the bill’s passing. One assemblyman stated that the bill was “a poke in the eye” to the President.

The bill intends to check the President’s pardoning power. No one is above the law.

As has been stated by numerous legal scholars, I have the absolute right to PARDON myself, but why would I do that when I have done nothing wrong? In the meantime, the never ending Witch Hunt, led by 13 very Angry and Conflicted Democrats (& others) continues into the mid-terms!
